Si tratta a oltranza e il governo ha un mese di tempo per mettere le mani in un ordinamento del settore che somiglia ad una giungla più che a norme di regolamentazione. L’accordo, o la tregua armata firmata ieri sera con i rappresentanti di categoria, deve passare al vaglio della base dei tassisti che, come le manifestazioni nelle strade di Roma dimostrano, non dormono sonni tranquilli e non hanno intenzione di mollare la presa.
La protesta, infatti, cova ancora e nelle prossime ore saranno i driver con licenza che protestano da sei giorni contro i “nemici” che sfrecciano sulle auto con la targhetta Ncc (Noleggi con conducente) e gli ancor più odiati “finti tassisti” di Uber che a prezzi stracciati ti portano comunque dove vuoi, a decidere il da farsi nelle assemblee che si annunciano roventi. La categoria è storicamente una di quelle meno disposte a cedere terreno e molto spesso si è ritrovata a fronteggiare a muso duro in strada la celere per far pesare i propri diritti fin dall’apertura del mercato 25 anni fa.
Ecco perché le prossime ore saranno decisive: la base vuole tutto e subito, e cioè niente sconti a Uber e strada ben separata dagli Ncc che devono restare, confinati – secondo quanto in vigore oggi – ad un noleggio delle auto circoscritto a zone specifiche e ben separate anche fisicamente – ad esempio negli aeroporti e stazioni – dalle auto bianche. Ma commi e piccole modifiche alle regole di ingaggio nel corso degli anni hanno complicato le cose e aperto la strada a cooperative di noleggiatori che hanno iniziato a pressare da vicino i tassisti, prendendo ad esempio le licenze di Ncc in piccoli Comuni limitrofi alle metropoli e lavorando ai fianchi i taxi nelle grandi città come Roma.
Ora, quindi, si cambia passo e l’accordo faticosamente raggiunto al ministero dei Trasporti – che promette di mettere mano a norme e commi sospesi nel limbo da molti anni – sarà ben presto messo alla prova. Il primo passo sarà la messa a punto del motore di un comma nascosto dalla polvere e inserito nel decreto legge 40 del 2010 – dove c’è di tutto, dalle slot ai dipendenti pubblici fino ai tassisti. Il testo in maniera contorta prevede la “rideterminazione dei principi fondamentali della disciplina di cui alla legge 15 gennaio 1992, n. 21, secondo quanto previsto dall’articolo 7-bis, comma 1, del decreto-legge 10 febbraio 2009, n. 5, urgenti disposizioni attuative, tese ad impedire pratiche di esercizio abusivo del servizio di taxi e del servizio di noleggio con conducente o, comunque, non rispondenti ai principi ordinamentali che regolano la materia. Con il decreto sono altresì, definiti gli indirizzi generali per l’attività di programmazione e di pianificazione delle Regioni, ai fini del rilascio, da parte dei Comuni, dei titoli autorizzativi”.
In sostanza si rivedranno le regole di ingaggio dei noleggiatori che oggi possono (quasi) operare come dei tassisti, creando cooperative, servendo territori più ampi di quanto disposto in origine e cioè quando il servizio di noleggio con conducente venne previsto dall’ordinamento. Ancor più delicato il caso Uber che, se le richieste dei tassisti dovessero passare, verrebbe di fatto depotenziato o quasi annullato.
I driver con licenza si aspettano quindi che quanto siglato in serata al ministero venga discusso e applicato quanto prima: “I decreti dovranno includere tutti i temi, già concordati con le categorie a suo tempo, tra cui miglioramento del sistema di programmazione e organizzazione su base territoriale, regolazione e salvaguardia del servizio pubblico, necessità di migliorare i servizi ai cittadini evoluzione tecnologica del settore, lotta all’abusivismo, migliore incontro tra domanda e offerta”. L’impegno è di iniziare i lavori domani e a concluderli per presentare i testi entro un mese. Altrimenti sarà di nuovo caos nelle strade.
